Agricultural Committee Approves Bill on Liberalizing Land Relations

The Committee of the Verkhovna Rada of Ukraine on Agricultural and Land Policy has recommended adopting as a basis the draft law No. 14087, which provides for a large-scale liberalization of land relations in Ukraine.

Main Innovations of the Bill

The document aims to simplify access to land resources, implement digital tools in the field of land management, improve the mechanism for confiscating land plots, as well as enhance the transparency and efficiency of managing state and communal lands.

One of the key proposals is to allow financing the preparation of land plots for sale from extrabudgetary funds. Subsequently, the expenses will be compensated by the winner of the land auctions, which will expedite the preparation of plots for sale and reduce the burden on budgets at various levels.

Digitalization of Land Management and Other Changes

The draft law provides for improvements in the mechanism for land confiscation. The State Service of Ukraine for Geodesy, Cartography and Cadastre (State Geocadastre) will be granted the authority to file lawsuits for the confiscation of land plots, which will necessarily be sold at land auctions after expropriation.

An important component of the innovation is the digitalization of land management. The introduction of an electronic interaction system will ensure prompt and transparent document exchange among all industry participants: project customers and developers, valuation entities, landowners, land users, state cadastral registrars, executive authorities, and local self-governments. Document submission and decision receipt will be possible in both paper and electronic forms.

“The draft law proposes to establish a simplified procedure for changing the intended purpose of land plots for the placement of family-type children’s homes, as well as to expand the list of objects for which simplified procedures for changing the intended purpose of land can be applied.”

Additionally, it is proposed to legally define the term “cadastral boundary of the territorial community” and instruct State Geocadastre to ensure its representation on the cartographic basis of the State Land Cadastre. The calculation of the normative monetary valuation of land will also be implemented using the software tools of the State Land Cadastre.
