Unscheduled Land Use Inspections Allowed in Ukraine During Martial Law
In Ukraine, the conduct of unscheduled inspections regarding land use and protection has been partially restored during the period of martial law. This decision is enshrined in the resolution of the Cabinet of Ministers of Ukraine dated January 28, 2026, No. 121, which amends the previously effective resolution No. 303 dated March 13, 2022.

Reasons for Conducting Unscheduled Inspections
The updated provisions allow state supervisory bodies to carry out unscheduled state control measures for land use and protection based on several grounds. In particular, such inspections may be conducted:
- based on a court decision;
- at the request of a business entity, if they initiate the state supervisory measure themselves;
- to verify compliance by enterprises with directives and other regulatory documents issued as a result of previous inspections;
- at the instruction of the Prime Minister of Ukraine, if systemic violations have been recorded or events have occurred that significantly affect the rights of citizens, environmental safety, or state protection (according to a decision by the Ministry of Economy);
- in the presence of threats that negatively impact the life and health of people, the state of the natural environment, as well as to fulfill Ukraine’s international obligations, or in connection with accidents, fires, incidents, or occupational diseases related to the activities of enterprises (according to a decision by the Ministry of Economy);
- in response to complaints from individuals regarding violations that have harmed their rights, legal interests, health, the environment, or state security, provided that supporting documents or their copies are submitted (according to a decision by the State Geocadastre).
New Control Rules Under Martial Law
According to the changes, state supervision (control) over land use and compliance with environmental legislation can be initiated by both government authorities and enterprises, citizens, or court decisions. This approach allows for a prompt response to threats and violations, especially in cases concerning the protection of life and health, the environment, or the fulfillment of Ukraine’s international obligations.

Such steps are aimed at ensuring effective state control in the field of land use even under the challenging conditions of martial law, which will contribute to the protection of citizens’ rights, environmental preservation, and state security.
