Ukraine has changed the rules for confirming work experience abroad before 1992

The Cabinet of Ministers of Ukraine has approved new rules regarding the confirmation and accounting of work experience for Ukrainian citizens who worked abroad before January 1, 1992, particularly in the territories of the former USSR republics. This decision was made in accordance with the Law of Ukraine “On Mandatory State Pension Insurance” and is aimed at addressing pension issues for this category of citizens.

Main Innovations in Confirming Work Experience

The government has defined two key procedures that regulate the process of confirming work experience for individuals who worked abroad before 1992:

  • Procedure for confirming the absence of pension payments from another state. This procedure establishes how to confirm that a foreign state does not make pension payments for the periods of work of a citizen before January 1, 1992. Only after receiving such confirmation can the corresponding period be counted towards the insurance experience in Ukraine.
  • Procedure for confirming and accounting periods of work in another state towards insurance experience. This document defines the procedure for including periods of work abroad into the total insurance experience, which significantly affects the right to receive an old-age pension in Ukraine.

Changes to Existing Procedures and Review of Pension Fund Decisions

In addition to implementing new procedures, the Cabinet of Ministers has also made changes to the existing rules for confirming work experience. In particular, item 22, which previously regulated the confirmation of work experience abroad in the Procedure for confirming existing work experience in the absence of a work book or relevant records, has been removed. Now, confirmation of work experience abroad will only be possible according to the new procedures.

“The Pension Fund of Ukraine has been instructed to review decisions made by territorial bodies of the Pension Fund of Ukraine from the date the Law No. 3674-IX came into effect. This concerns decisions related to the regulation of the calculation of insurance experience and pension provision. This must be done before the new procedures come into effect. This applies to citizens who worked abroad before 1992.”

The main goal of the innovations is to ensure the correct calculation of insurance experience and to avoid possible discrepancies in the assignment of pension payments for individuals who worked abroad before the beginning of 1992.
